DISTANCE SALES AGREEMENT
ARTICLE 1 – PARTIES
1.1. 1.2. BUYER: The individual or legal entity who makes a reservation/purchase via the website and whose contact details are provided during the booking process.
ARTICLE 2 – SUBJECT OF THE AGREEMENT The subject of this Agreement is the sale and delivery of daily tours, paragliding, and activity services ordered electronically by the BUYER through the SELLER’s website. This agreement is governed by the Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
ARTICLE 3 – SERVICE DELIVERY AND EXECUTION 3.1. After the payment is completed, the digital ticket/voucher for the purchased service will be sent instantly to the BUYER via WhatsApp or E-mail. 3.2. The BUYER is responsible for presenting this digital voucher or the physical ticket (which can be collected from our office) at the time of the activity.
ARTICLE 4 – CANCELLATION, REFUND, AND THE RIGHT OF WITHDRAWAL 4.1. Exception to the Right of Withdrawal: Pursuant to Article 15 (g) of the Regulation on Distance Contracts; “Contracts related to the utilization of free time for purposes of accommodation, transport of goods, car rental, supply of food and beverages, and entertainment or recreation, which must be performed on a specific date or period” are exempt from the right of withdrawal. 4.2. Sky Fethiye Cancellation Policy: Notwithstanding the legal exemption above, the SELLER provides the following refund terms for customer satisfaction:
Cancellations made at least 36 hours before the scheduled service time: 100% Full Refund.
Cancellations made less than 36 hours before the service time: No refund will be issued as preparations are finalized and slots are blocked. 4.3. Weather Conditions: Activities such as paragliding are subject to weather conditions. If the service is cancelled by the SELLER due to safety or weather reasons, the BUYER will be offered a full refund or a free rescheduling.
ARTICLE 5 – GENERAL PROVISIONS 5.1. The BUYER acknowledges that they have read and understood the fundamental characteristics, sales price, and payment terms of the service. 5.2. The SELLER is responsible for providing the service in accordance with safety standards and the descriptions provided on the website. 5.3. If the BUYER fails to attend the activity on time (“No-Show”) or arrives under the influence of alcohol/substances that prevent participation, no refund shall be issued.
ARTICLE 6 – LEGAL JURISDICTION In the event of a dispute arising from this agreement, Consumer Arbitration Committees and Consumer Courts in Fethiye, Muğla/Turkey shall have jurisdiction, up to the value declared by the Ministry of Trade.
